Actual service agreement policies will be tailored based on the services provided by Portland Nannies and presented to each family we serve. 

Portland Nannies shall use its best efforts to place a qualified, acceptable nanny with the family. Nannies referred by Portland Nannies are not employees, agents or representatives of Portland Nannies.  If the family hires a nanny referred by Portland Nannies the family agrees to contract with the nanny directly as to the terms of employment.  Portland Nannies assumes no responsibility for the family’s or the nanny’s compliance with laws regarding payment or withholding federal, state or local taxes, social security, Medicare, unemployment, or immigrations laws.  Portland Nannies is not responsible for any health insurance or other employee benefits of nannies.

A non-refundable registration fee of $200.00 is due with this application. This fee is to activate the family’s application and begin the search process. The following are the placement fees if the family decides to hire a nanny that is referred to them by Portland Nannies.

$1600.00 for a full or part time nanny placement
$1600.00 for a household management placement
$1400.00 for a permanent babysitter placement
$1200.00 for a newborn nanny placement (up to 12 weeks)
$200 per week for a temporary nanny placement (1-8 weeks, $200-$1600)

The placement fee is due once the family offers and nanny accepts the position. If you have a past due balance, the fee will be charged to your account on file with Portland Nannies.

Portland Nannies offers a 90 guarantee from the date your nanny starts for one replacement nanny.

90 Day Guarantee
If within the first 90 days the family finds the nanny to be unsatisfactory, or, if the nanny should resign, Portland Nannies will attempt to provide a qualified replacement at no additional fee to the family.  We will make every possible effort to find you a replacement, however, if we are unable to find a candidate for you and you hire someone who is not through Portland Nannies, we would honor our commitment when you are next in need of a nanny within one year.

Please be aware that our ninety day replacement guarantee is contingent upon the fee being received by us within two weeks of the family receiving the placement fee invoice. 

At no time is there a refund of the registration or placement fee.

**There is no guarantee for a temporary or on-call nanny placement.**

The family shall refrain from making any private agreement with the nanny or from taking any action which is inconsistent with this agreement or which has the effect of avoiding any of the  family’s obligations herein.  Such private agreements and actions include, but are not limited to, actions which would enable the family or any other person to avoid payment of the placement fees due to Portland Nannies as, for example, if the family knowingly refers the name of the nanny to another person who subsequently hires the nanny.  The family is liable to Portland Nannies for all damages in the event the family refers any Portland Nannies referral to a third party.

Any claim or controversy arising out of or relating to this agreement or the breach thereof shall be settled by arbitration’s in the State of Maine in accordance with the rules of the American Arbitration Association, and the judgment upon the award of the arbitrators may be entered in any court having jurisdiction thereof.  This agreement is governed by Maine law.  The prevailing party in any dispute between Portland Nannies and the family shall be entitled to recover its attorney’s fees.

The family hereby releases Portland Nannies and its members, officers and employees from all claims and causes of action that the family may have against Portland Nannies now or in the future, including but not limited to claims resulting from the negligence of Portland Nannies and its members, officers, and employees.  Portland Nannies is not liable for the acts or omissions of the nanny, including but not limited to negligence, recklessness or intentional conduct.  Portland Nannies is a referral service only and shall not be liable for any damages caused by a nanny referred to the family.  Portland Nannies is not liable for any claims or whatever nature the nanny may have against the family and the family hereby agrees to indemnify and hold Portland Nannies harmless from any and all such claims.  The family agrees that if Portland Nannies finds in its sole judgement that the nanny is being subjected to exploitative conditions in the family’s household, the nanny may terminate the nanny’s employment from the household.  In that event, the family shall not be entitled to a replacement or refunds of the nanny placement fee.
